Terms and Conditions: Clients
By registering online as a Rockmybaby® Client and agreeing to our Terms and Conditions (via the required tick box), or by engaging a Rockmybaby® Candidate temporary, or permanent services, you acknowledge and accept these Terms & Conditions.
Links to these Terms & Conditions are available on our homepage and throughout our FAQ section for easy access.

1.0 Contract
These Terms & Conditions form a legally binding agreement between you ("Client") and Rockmybaby® Nanny Agency ("Agency").
Completion of any of the following constitutes acceptance of these Terms: Registering on the Rockmybaby® website and submitting a Job Request.
"Candidate" refers to any individual introduced by Rockmybaby® to the Client.
"Nanny" refers to a registered childcare professional engaged in a full-time, part-time, or temporary capacity.
By registering with Rockmybaby® or using our website/services, you agree to abide by these Terms. If you do not agree, please do not proceed.
Posting false, incomplete, or illegal information is prohibited and may result in legal action.
2.0 Client Responsibilities
2.1 All communication with Rockmybaby® or its Candidates is confidential and may not be shared with third parties.
2.2 Clients are responsible for ensuring a safe working environment for Candidates.
2.3 Rockmybaby® may decline referrals based on negative or concerning feedback about a Client.
2.4 Clients must maintain confidentiality regarding Candidate details. Sharing a Candidate’s information that leads to employment by another party may result in agency fees.
2.5 Clients are responsible for safeguarding their account login details and for notifying Rockmybaby® of any unauthorized use.
2.6 The Client agrees not to approach or engage any Rockmybaby® Candidate independently during or after an introduction by the Agency, for a period of 12 months. Any breach of this will incur the full placement fee.
3.0 Candidate Obligations
3.1 Clients must notify Rockmybaby® of any extension or re-engagement of a temporary placement. Temporary placements (up to 3 months) are charged at a daily/weekly rate as per Rockmybaby®’s current fee schedule. Any extension or re-engagement of a Candidate within 12 months of the initial placement (temporary or permanent) must be reported and is subject to additional placement fees.
3.2 Any Candidate referred from another source but registered with Rockmybaby® will be subject to agency fees if employed.
3.3 Clients are the legal employer/contractor of the Candidate and must fulfill all legal obligations, including: AHV, BVG, Insurances and Taxes, Permit and work eligibility checks, Providing insured, roadworthy vehicles if required to drive.
3.4 Where a Client wishes to engage a Candidate for a trial period, trial fees will apply. The applicable placement fee will be charged if the candidate is subsequently offered permanent employment. Trial engagements must be arranged through Rockmybaby® and confirmed in writing.
4.0 Candidate Offer Cancellations
4.1 Early Client cancellation: 50% of agency fee payable, minimum 1000CHF + VAT.
4.2 Early Candidate cancellation: Full refund or replacement offer.
4.3 Temporary placement cancellations within 24 hours: 50% of Nanny wage payable.
4.4 Services may be cancelled immediately if a Candidate is mistreated, or the environment is unsafe.
4.5 Temporary placements cancelled by the Client within 72 hours of start will incur a 50% charge of the total agreed wage. Same-day cancellations will incur 100% of the first day’s wage.
5.0 Placement Refunds & Guarantee
5.1 Guarantee applies only to invoices paid within the due date.
5.2 No refund on agency fees. One replacement nanny is offered if the original nanny leaves within 12 weeks. Up to 3 nanny profiles will be provided.
5.3 Guarantee void if Candidate leaves due to Client conduct or conditions.
5.4 A placement is deemed successful after 12 weeks.
5.5 No refund will be given if a nanny's temporary placement is reduced after the start date.
6.0 Liability
6.1 Clients waive the right to bring legal action against Rockmybaby® regarding published information.
6.2 Rockmybaby® is not liable for accidents or misconduct by Candidates.
6.3 Candidate vetting is thorough, but the final employment responsibility lies with the Client.
6.4 Clients must ensure their insurance includes coverage for domestic employees.
6.5 Rockmybaby® is not responsible for third party website content or links.
6.6 Clients outside Switzerland must ensure compliance with their local laws.
7.0 Confidentiality
7.1 Credit card payments are securely processed and PCI DSS compliant. Rockmybaby® website uses Windcave - our credit card payments are secure certified and compliant to the Payment Card Industry Data Security Standards (PCI DSS), as a level 1 processor; this includes quarterly scans of its systems and annual onsite audits by a Qualified Security Assessor (QSA). DPS PCI compliance validation can be found in VISA's Global List of PCI DSS Validated Service Providers.
7.2 All communication between the Agency and Client is confidential.
7.3 Clients must provide accurate and complete personal details.
8.0 Privacy

9.0 Warranties & Indemnities
9.1 Clients are not agents of Rockmybaby®.
9.2 No guarantees are made on Candidate suitability or character.
9.3 Employment contracts and compliance are solely the Client’s responsibility.
9.4 Clients agree to indemnify Rockmybaby® against any claims resulting from Candidate engagement.
9.5 Site access is not guaranteed to be uninterrupted.
10.0 Disputes

10.2 All dispute-related communication must go through Rockmybaby®, not the Candidate.
11.0 Copyright & Trademarks
11.1 All website content is the property of Rockmybaby® IP Ltd and is protected by copyright law.
12.0 Governing Law
12.1 Governing Law
The Terms & Conditions shall be governed in accordance with the laws of Switzerland and users hereby submit to the non-exclusive jurisdiction of the Courts of that state.
12.2 Rockmybaby® IP and copyright are owned by Rockmybaby Group, PO BOX 8720, Havelock North, NZ 4157.
12.3 Rockmybaby® reserves the right to update these Terms at any time.
