Contract

The below Terms & Conditions are a legal binding agreement between you as the candidate and RMB as the agency. This is for Rockmybaby^® Group and franchised companies – Rockmybaby GmbH

Completion of the following – registering on RMB website and completion of the Registration Form – is instant acceptance of the agency Terms & Conditions.

The word “RMB” refers to Rockmybaby Group (Agency) and franchised areas.
The word “Babysitter”, “Nanny” and/or "Private Household Staff” or “Education Staff” refers to any person that RMB introduces to the client.
The word “Client” refers to the person/family using RMB services.

The Terms & Conditions are the terms of which RMB offers the candidates access to the services and use of the RMB website and agency. By registering with RMB the candidate agrees to abide by these Terms & Conditions. If the candidate does not agree to abide by these Terms and Conditions, then the candidate must refrain from using the RMB website.

Posting false, incomplete, inaccurate or illegal information is strictly prohibited and may be punishable by law.
Unlawful or illegal use will be reported to the proper authorities and may be punishable by law.

Candidates minimum standards

• For “Babysitter”, “Nanny” and/or "Private Household Staff” - the candidate will not remove any child/ren from the residence/accommodation location unless the client authorizes the sitter to do so.
• RMB requires all our candiates to be reliable, courteous, and enthusiastic and to use your initiative at all times.
• On absolutely NO occasion are you the babysitter permitted to have any friends, family or partners at the babysitting booking.
• Babysitter agrees never turn up to a babysitting placement under the influence of drugs or alcohol.
• The babysitter is the primary caregiver of RMB client's children, under NO circumstances are you to leave the children alone.
• When a babysitter accepts a babysitting booking, it is vitally important for you (as the babysitter) to call the RMB client 24 hours after accepting the booking. This call is to introduce themselves, confirm again start/finish times, babysitting address/directions and ask of any additional special requirements.
• The candidate must always respect RMB client's privacy and leave the environment as you found it.
• The client's private telephone is not to be used except under emergency situations.
• The babysitter is to take along with them the Job Summary form to each babysitting bookings.
• Babysitters and Nannies agree to only charge clients the advertised hourly rates on our website, under no circumstances are you to charge different rates.
• If the babysitter confirms a babysitting booking, then the babysitter is responsible to up hold their commitment, to the client and to RMB.
• If the babysitter cancels a RMB babysitting booking, you must advise RMB no later than 24 hours before the babysitting booking is due, this gives RMB time to find a replacement sitter. If the cancellation is done within 24 hours of the booking commencement time you are required to call both RMB and the client directly.
• As a RMB babysitter you are strictly not allowed to make any private bookings with RMB clients. Should this be discovered fees will apply to both you and the RMB client and you will NO longer be part of the RMB team!
• If RMB has put  the candidate forward for any positions - the candidate is required to inform RMB when they are planning to have an interview with the client and also if employment has been offered. If the candidate has been put forward to the same position that is advertised via third parties – the candidate must inform RMB immediately, the candidate must make RMB aware if RMB or the third party put them forward for a position first.
• All candidates are to dress professionally.
• Any correspondence, communication either verbally, written or via email is confidential and the candidates agrees not to disclose to third parties.
• Candidates are responsible for the continued confidentiality of their login details – in an event of unauthorised use by a third party; your account may be deleted.
• Users must ensure that they exit from their account at the end of each session on the RMB website.
• Users agree to immediately notify RMB of any unauthorised use of their login or password.

Candidate Acknowledgement

• RMB reserves the right to de register/delete the candidate user profile; if you do not meet our criteria, fail to turn up for an interview with RMB, fail to turn up to an interview with a client, do not meet our minimum standards, do not keep your contact details up to date.
• RMB operates as an introduction agency between the client and the candidate – RMB does not employ our candidates.
• RMB is not responsible for payment of candidates salaries.
• RMB cannot guarantee a set amount of referrals for babysitter’s bookings.
• RMB cannot guarantee the candidate will gain any  placements, the decision lies with the clients.
• RMB is not liable for any payment disputes between an RMB client and you (the candidate).
• Keep CVs up to date and information factual.
• RMB will conduct conduct an interview with all suitable candidates.
• RMB will verify credentials checks.

Guidelines for your own safety

• If under any circumstances you (the babysitter or nanny) feel threatened or unsafe, then you should leave straight away, as long as you are not leaving children home alone. Please contact us immediately.
• Let a friend or relative know exactly where you are and what the expected finish time is.
• Make sure your friend or relative has a copy of contact details, address, name of the clients and phone number.
• Keep a charged cell phone with you.
• Always park your car close by, under street lights.
• When forwarding CVs – take out all personal contact information such as full date of birth, street address, contact phone numbers. Send CVs as PDFs so no one can change your details.

Liability

By using the RMB Agency the candidate expressly authorises RMB to collect and publish information about them as detailed in these Terms & Conditions and the candidates expressly waive any rights, whether in statute or at common law, to bring any legal action against RMB as a result of RMB's publication of such information, whether the candidates considers that information to be fair and accurate or not.

RMB acts as an agent for the candidate not as an employer of the candidate. Therefore the agency accepts no liability or responsibility for accident, injury, loss, damage or misconduct sustained by candidate, clients or any other persons and by employing a candidate or booking a babysitter through RMB. The candidate agrees to exclude the agency should any mishap occur.

RMB website does contain links to third party advertisements and links to third party sites. Access to any other Internet site linked to RMB website, is at the clients own risk. RMB accepts no responsibility for the accuracy or reliability of any information, opinions, or statements made in any third party advertisements or on any third party sites.

Confidentiality

All communication between both parties (Agency and Candidates) shall remain confidential.

RMB requires the candidates to provide accurate details of their address, contact details and full name.

RMB will release account and other personal information only when the above release is appropriate for the function of the website, to comply with the law; enforcement of our terms and conditions; or protect the rights, property, or safety of RMB Group, our users or others.

Privacy

RMB does not sell or rent the candiates personal information or identification to third parties.

RMB does employ other companies and individuals to develop, maintain and improve the website. These people have access to personal information stored within this website in relation to performing their work. This information is confidential and they may not use it for other purposes.

As RMB Group continues to develop our franchise business, there may be a change in ownership from Head Office to the new franchisee. When a change over occurs, babysitters/nannies information will be one of the transferred assets.

RMB will release information to third parties when we believe this is appropriate to comply with the law, police or fraud investigations, to protect the rights of RMB Group, our IP, our users or others.

Warranties

No warranty is given for suitability honesty and capability, character of any clients.

We make no warranties or representations as to the quality, accuracy or completeness of the content on the site or the information otherwise provided by any member.

While RMB uses reasonable endeavours to ensure that the site is available 24 hours a day, RMB does not make any representations or warranties that your access will be uninterrupted or error free. Access to the site may be suspended temporarily without notice in the case of system failure, webhosting errors, maintenance or repair or any reason beyond our control.

Disputes

RMB prefers to resolve any disputes via mediation. Firstly contact your area office.

If your local office fails to effectively respond or resolve the babysitters/nannies complaint please contact Head office info@rockmybaby.ch with full details.

Copyright and Trademarks

All content on RMB website – texts, graphics, images, HMTL codes and other material (collectively the “Material”) are protected by Australian and international copyright laws and remain the exclusive property of the Rockmybaby IP Ltd Company.

Governing Law

The Terms & Conditions shall be governed in accordance with the laws of Switzerland and users hereby submit to the non-exclusive jurisdiction of the Courts of that state.

RMB website, IP, Copyright is owned and registered by Rockmybaby^® Group, based at PO BOX 8720, Havelock North, New Zealand, 4157.
